Terms & Conditions
H2 means H2 Clubs Victoria Limited (Company registration number 10295031).
All H2 Members, guests, and those periodically visiting (together “you”) an H2 Club in operation in the UK (a “Club”) must comply with these Rules. These rules are incorporated into a Member’s contract with us, and compliance with these Rules is important to both maintain the standards at our Clubs and to enable Members to get full enjoyment from their time at the Club.
The term Membership refers to both a monthly/annual paying customer who pays by either Direct Debit or Credit/Debit Card and also any person who has any credit loaded on their personal account and/or is using H2 facilities.
By following the joining process to become a Member, either via our website or in club with member of the H2 team, you are agreeing to accept the terms and conditions of this membership agreement.
Any person who does not comply with these Rules may be ejected from, or denied access to a Club, or may have their Membership terminated by H2 Clubs Victoria Limited if the non-compliance is serious.
1. General Membership Terms
a) Membership entitles Members access to use the facilities available at their home Club. We offer different types of Memberships and facilities at each Club, and the types of memberships and facilities offered by us will differ from Club to Club, and may change from time to time.
b) Each category of Membership has different restrictions, conditions and benefits. Another category of Membership or Club may be of interest to you if your requirements or circumstances change. You should contact your Home Club if you would like further details of different types of H2 Memberships that are available.
c) Monthly paid memberships. This membership is a rolling month to month agreement payable via Direct Debit. This agreement will continue to run until cancelled by the individual.
d) Annual paid memberships are a 12 month agreement. These must be paid for upfront, in full by debit or credit card and is not refundable. After the paid term, this membership will Lapse automatically unless renewed by the Member and the renewal fee paid to H2.
2. Freeze Service
a) If you are unable to use the club for a period of time you may freeze your membership. Freeze requests must be made in writing to the club before your invoice date.
b) There is a £10 monthly freeze fee and you can freeze for a minimum of 1 month and up to 6 months within a calendar year. After this time your membership will be automatically unfrozen and your monthly Direct Debit returned to the normal rate. In the rare event that any changes to membership rates occur during your frozen time, you will be advised of your new rate when unfreezing.
c) Freezes cannot be applied retrospectively.
d) Lockers cannot be frozen. You will continue to be charged your locker each month as normal unless you choose to cancel and empty your locker subscription.
3. Membership Card & Access
a) A card will be issued for each monthly or annual Membership when you join a Club.
b) There is a fee of £5 for replacement of lost, stolen or damaged cards.
c) Each Members must have his/her card swiped for security and verification on each visit to a Club before proceeding into the Club. Any Member visiting a Club without a valid Membership Card may be asked for proof of identification.
d) A Member must not lend their Membership Card to anyone else as membership is personal and covers only that Member’s use of the Club.
e) PAYU or Member Guests will not be issued with a Membership card. Soho visitors can make use of a temporary card in order to use a locker whilst in the, issued and returned to the front desk in exchange for a debit/credit or ID card. Victoria visitors will require to bring a padlock to secure a locker during their visit.
f) H2 Victoria members and guests must not veer anywhere in the Verde building outside of the H2 demise. H2 members and guests who are found outside of the H2 demise in the Verde building will be asked to leave and their access to H2 may be suspended or terminated.
4. Corporate Membership
a) H2 offer reduced membership rates to companies that join a minimum of 5 members. The rates are banded according to the number of people in the agreement.
b) Corporate membership bands are reviewed biannually. If member numbers have reduced/increased at the point of review, you will be notified of the adjustment in rate accordingly.
c) Any change in membership prices within an existing band during the year will be notified and communicated to the appointed Corporate contact.
d) By arranging a Corporate Membership at H2, you agree to ensure that information relating to the Club and to the preferential rate of membership is communicated to all current and future employees and that occasional communication relating to the Corporate Membership will be distributed by the nominated contact within the company.
5. Guests & Visitors
a) Complimentary trials are offered to prospective Members at the discretion of H2.
b) All Guests must provide proof of ID when entering the premises.
c) Guests wishing to attend a class on a one-off basis should purchase a PAYU credit to do so.
d) Members (over the age of 18) may bring guests to a Club provided: (a) we receive payment of the guest fee; and (b) the guest completes a Pre-Activity Questionnaire as requested by us.
e) Members must accompany their guest in the Club always, and the Member who brings the guest remains responsible for their guest’s conduct whilst they are in a Club.
f) Certain former Members, employees or guests may be ineligible to be a Member, or guest, of a Club. If in doubt, the Member should check with the Club’s management for advice.
g) A Member who has Frozen their Membership will not be allowed access to any Club without a valid guest pass or paying the current guest fee.
h) A person may be allowed to enter as a visitor to a Club by prior arrangement, subject to H2’s discretion, and may be required to pay the guest fee. All visitors must complete a Pre-Activity Questionnaire.
6. General
a) Opening times for a Club will be advertised on the website.
b) The Club may close from time to time where necessary for maintenance or security purposes. H2 will endeavour to provide as much notice as possible in advance of such closures.
c) We reserve the right to show potential Members and other individuals the facilities of a Club on a trial basis.
d) Members of a Club, their guests, visitors and members of staff should at all times display mutual respect for each other.
e) Complaints should be communicated privately to a member of the relevant Club’s management.
f) Members are respectfully requested to store coats, helmets, shoes and rucksacks in the lockers provided.
g) Any personal belongings left in the Club, unless in a designated private locker, will be treated as Lost Property.
h) You agree to keep us informed of any chance to your personal details and contact information.
i) Belongings left on the premises are done so at your own risk and H2 does not accept liability these.
j) Social Media and community engagement is integral to our business. Where possible we like to capture good moments in photographs. These will be used for our marketing and social media activity. If you do not want us to use images of your face, please notify the club accordingly.
7. Gym/Studio Use
a) Appropriate clean exercise clothing and shoes must be worn whilst exercising.
b) Cardio equipment must not be used for longer than 20 minutes during busy periods.
c) You are asked to use a sweat towel where appropriate and wipe down gym equipment after use.
d) You are asked to arrive at the Club prior 5 minutes early to any Personal Training or Induction appointments. We reserve the right to refuse to re-book an appointment for you if you repeatedly cancel (with less than 24 hours’ notice) or fail to keep an appointment for services and/or exercise programmes.
e) You may not use the gym or studios while under the influence of alcohol, anticoagulants, narcotics, tranquilizers or any medication which may affect your ability to exercise safely.
f) Put away all equipment at the end of the class.
g) Injuries must be reported before each class.
8. Studio Classes
a) Classes will be made available for booking on a weekly basis. You will be notified on Monday the previous week once available. You must pre-book classes to ensure your participation in them.
b) Classes can be cancelled up to 12 hours before the class start time without incurring a charge, any credits related to your booking will be returned to your H2 account in full.
c) If a class cancellation is made within 12 hours of the class start time or if you do not attend without notice(“no-show”) you will be charged the full class rate, and no refunds will be given.
d) If you are not present at the scheduled start of the class, your spot may be given to a waitlisted client.
e) Waiting list- if you join a waiting list, and a spot becomes free, you will be charged the full credit price for the class. Bookings will be made automatically when a spot becomes free, on a first come, first served basis. If you no longer wish to be on a waitlist, it is your responsibility to remove yourself via the My Account area.
f) You may only have 6 booked classes at any one time to allow other members a fair opportunity to book classes.
g) If you persistently fail to turn up, your booking rights may be suspended.
h) Class credits are not refundable and must be used within the validity period specified on purchase.
i) Class timetables and instructors are subject to change from time to time without notice.
j) To avoid disturbing classes, you are requested to arrive in good time. Entrance to classes may be denied to anyone arriving more than 5 minutes late.
k) Where, in the opinion of an instructor, a class is overcrowded, the instructor may restrict the number of attendees in the class.
l) An instructor may, at any time, ask you to leave a class if you are jeopardising the safety or enjoyment of others.
m) We reserve the right to limit your participation to only one exercise class per day.
9. Lockers
a) Lockers are made available subject to availability. H2 does not undertake that use of a locker will guarantee that no theft or damage to your property will occur. We will not accept any liability in relation to locker thefts.
b) Lockers may only be used for the purposes of keeping gym kit, toiletries, and clothing. If H2 has reasonable grounds to suspect that a locker is being used for other storage, H2 reserves the right to open the locker in question (by force if necessary) and remove any offending items.
c) With the exception of any designated private lockers, lockers are available for use only while you are on the Club’s premises. Use of a locker (other than any designated private lockers) while not on Club premises is prohibited. If you leave your belongings overnight in a locker (other than in any designated private locker), H2 reserves the right to open the locker (by force if necessary) and remove your belongings.
d) Belongings will be available for collection from the relevant Club’s Reception for a period of 28 days. If you do not collect your belongings within 28 days, your belongings may be donated to charity.
e) If you rent a designated private locker, and if the rental fees in respect of that locker remain unpaid for more than 1 month after the date due for payment, H2 reserves the right to open the locker (by force if necessary) and remove your belongings. Your belongings, so removed, will be available for collection from the relevant Club’s reception for a period of 28 days. If you do not collect your belongings within 28 days, your belongings may be donated to charity.
f) If you rent a designated private locker, a padlock may be provided to you by H2, for which you must pay a deposit. This deposit will be refunded at the point at which the private locker rental is cancelled and the padlock is returned, and reset, by a member of H2 staff.
g) You agree that H2 is in no way responsible for the safekeeping of your personal belongings while you are in a Club. You assume all risk of loss for any of your personal belongings.
10. Bike Park
a) The bike park is available to you as long as you have a valid membership to do so.
b) Parking in H2 Clubs is subject to the use of a D lock at all times. If your bike is not locker it will be locked by H2. If this happens more than once then you will be charged the cost of a D lock to be used at the club.
c) All bikes in the bike park must be registered to a valid Membership and member bike tags must be clearly visible.
d) Bikes left in the bike park without a valid bike tag, may be removed immediately without notice.
e) Bikes may not be left overnight unless you have the right membership to do so.
f) Bikes left for more than one night may be removed and bikes left in the Club for 6 weeks or more without permission will be disposed of.
g) Members are respectfully requested to store clothing & belongings in the lockers provided.
h) Rails are provided for wet clothes but left at members’ own risk. H2 are not liable for any clothing or belongings left in the bike park.
i) You agree that H2 is in no way responsible for the safekeeping of your bike while you are in a Club. You assume all risk of loss for your bike while it is left at the Club.
11. Health & Safety
a) You must read the health & safety notices posted around the Clubs and comply with their recommendations.
b) You must comply with any reasonable requests made by members of staff in relation to matters of health & safety.
12. Liability
a) By agreeing to accept the terms and conditions of this membership agreement or attending classes, events, activities and other programs and using H2 facilities and equipment, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in the strenuous nature of exercise. You acknowledge you that you have voluntarily chosen to participate in a program of physical exercise.
b) You acknowledge that H2 strongly recommends that you consult your physician prior to commencing an exercise programme.
c) You further acknowledge that the specific risks vary from one activity to another, but range from (1) minor injuries such as scratches, bruises and strains; (2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks or concussions; and (3) catastrophic injuries including paralysis and death.
d) At all times, you shall comply with all stated and customary terms, posted safety signs, rules and verbal instruction ns given to you by trainers and staff.
e) In consideration of being allowed to participate in and access the H2 classes and studio facilities, you hereby (i) agree to assume full responsibility for any and all injuries or damage which are sustained or aggravated by you in relation to H2 classes & studio facilities, (ii) release, indemnify, and hold harmless H2 Clubs, subsidiary affiliate entities and franchisees, and each of their respective members, employees and representatives and agents, and each of their respective successors and assigns and all others, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages, and liabilities to the fullest extent allowed by law arising out of or in any way related to participation in the H2 classes or studio facilities, and (iii) represent that you have – no medical or physical condition that would prevent you from properly using any of H2’s classes or studio facilities, - do not have physical or mental condition that would put you in any physical or medical danger, and – have not been instructed by a physician to not participate in physical exercise.
f) You are participating in the workouts voluntarily and at your own risk.
13. Protecting Your Data
a) We use data through our website (www.h2clubs.co.uk and other pages therein) in order that we can fulfil services such as membership sign-up, class bookings, or credit purchases. H2 Clubs follow the guidelines in the General Data Protection Regulation (GDPR) legislation valid from May 2018, and have a Privacy Statement that can be viewed by clicking the following link: H2 Clubs Privacy Statement where you can view the data we collect and what we do with it
b) Any periodical communication to members will contain information valid to the services you pay for, such as changes to class timetables and or changes to services. Any member receiving these communications is able to remove themselves from mailing lists via a link on the communication. Any specific individual communication will only be sent if pertinent to your membership, either to notify you of a change, and/or to check details linked to sensitive areas of your membership such as payment details. In line with our Privacy Statement, this data will only be used to fulfil the actions linked to the services we provide, and not for any other use.
b) We collect data to set your membership up when you join, linked to your name, address, email, company name, date of birth, and bank details, which we then retain for future payments. You can check, edit or delete these details at any time by viewing the dashboard area of the H2 Clubs website once logged in, although bear in mind that editing or deleting this information may mean your membership is invalidated. All data is securely stored on a MySQL server and our Data Processor can access it at any time if you wish to view, edit or delete this data. To request this, please email crew@h2clubs.co.uk
c) H2 does not sell, trade, or pass your data to any third parties. The only third parties that use your data by H2 Clubs are those that provide a critical service to administer your membership, such as a Direct Debit provider, without whom your membership would be invalidated. Please refer to the Privacy Statement link in section 13 (a) for further details
d) Any non-vital and/or promotional communication will always be preceded by a request to opt-in to receive it. Any recipient of these communications can always opt out by clinking the unsubscribe from the list (or similarly worded) link from within the communication.
14. Promotions
a) Promotional offers on locker, classes or memberships are applicable for the time stated at purchase. When the promotional period ends, services will continue at the advertised RRP.
b) If you cancel your membership at any point during your promotional period that promotion will no longer be valid if you choose to re-join.
c) Promotional offers are at the discretion of H2.
15. Membership Cancellation
a) To cancel your monthly membership, you need to email victoria@h2clubs.co.uk stating your full name and reason for cancellation. In addition to this you are responsible for cancelling your Direct Debit with your bank.
b) If you wish to cancel your Direct Debit, you must do so prior to the 25th of the month or the proceeding months' Direct Debit will still be payable
c) Once we receive notification of cancellation of your Direct Debit from the bank, your membership will lapse immediately and all membership privileges will cease.
d) Annual memberships will lapse on the last day of the paid 12 month period.
